Algemene voorwaarden
01 Validity of These Terms and Conditions
These terms and conditions apply to all rental agreements entered into by Lach je Lens. Any terms and conditions of the other party, hereinafter referred to as the renter, shall not apply unless otherwise agreed in writing. An order placed by the renter constitutes acceptance of these general terms and conditions of the landlord.
02 Payment Terms
No deposit is required for the rental of a photobooth from Lach je Lens. Payment of the full amount must be made six weeks before the agreed date.
03 Cancellation of the Rental
In the event of cancellation of the agreement, the renter shall owe Lach je Lens the following:
03.1 Up to 45 days before the agreed event date: 15% of the total rental amount, with a minimum amount of €150.
03.2 Within the period from 45 days to 7 days before the agreed event date: 50% of the total rental amount.
03.3 In the event of cancellation from the 7th day before the start of the event up to the day before the event: 75% of the total rental amount.
03.4 In the event of cancellation on the day of the event: The full rental amount.
04 Installation and Dismantling of the Lach je Lens Photobooth
04.1. Lach je Lens will arrive at the agreed location approximately one hour before the agreed rental period, unless otherwise agreed with the renter. If Lach je Lens is required to be present at the location earlier, an additional charge will apply, depending on the agreed period.
04.2. The renter is responsible for informing the location of the arrival and arrival time of Lach je Lens.
04.3. If necessary, Lach je Lens expects assistance from the renter or the location with the installation of the photobooth.
04.4. The Lach je Lens photobooth will always be dismantled immediately after the end of the agreed rental period, unless otherwise agreed with the renter. If Lach je Lens is required to dismantle the photobooth at a later time, an additional charge will apply, depending on the agreed period.
05 Access to the Address and Location
05.1. Placement and installation of the photobooth will always take place on the ground floor, unless the photobooth can be moved to another floor using an elevator. The renter is responsible for checking that the elevator has the correct dimensions.
05.2. Lach je Lens is not responsible if the photobooth cannot be placed at the desired location because the location does not meet the installation requirements communicated in advance.
05.3. The photobooth must always be able to be installed in a dry and sheltered location. The renter is responsible for this. If the photobooth cannot be installed in a sheltered and/or dry location, Lach je Lens reserves the right not to commence the rental period, and any resulting costs will be borne by the renter.
05.4. The location, including its entrance, must be accessible to a work van with a trailer.
06 Rental Period
06.1. The agreed rental period is normally a continuous period of 4 hours, unless otherwise agreed between the renter and Lach je Lens.
06.2. The rental period begins at the agreed start time and ends at the agreed end time.
06.3. If the rental period cannot start at the agreed start time due to circumstances caused by the renter or the location, the rental period will nevertheless end at the previously agreed end time.
06.4. If the renter wishes to extend the rental period during the event, this can be discussed with the Lach je Lens employee present at the event. If approved by the employee, the rental period can be extended accordingly.
07 Force Majeure
07.1. Lach je Lens will make every effort to arrive at the location. If circumstances beyond the control of Lach je Lens arise that prevent the location from being reached, such as extreme weather conditions or vehicle problems, Lach je Lens will inform the renter and/or location as soon as possible. If Lach je Lens is unable to reach the location for any of the aforementioned reasons, the full rental amount will be refunded.
07.2. If Lach je Lens does not arrive at the agreed time due to circumstances such as traffic delays or vehicle problems, Lach je Lens will adjust the agreed end time in order to still provide the agreed rental period. If this is not possible, Lach je Lens will compensate for the delayed time in proportion to the number of hours rented.
08 Termination of the Rental
08.1. Lach je Lens reserves the right to terminate the photobooth rental period prematurely if threatening behaviour occurs toward one or more Lach je Lens employees, or if a threatening or unsafe situation arises at the event or location. This also applies if the photobooth or other materials belonging to Lach je Lens are misused by persons present at the location, or if Lach je Lens equipment is damaged or is at risk of being damaged due to the actions of the renter, the renter’s guests, or other persons present at the event or location.
08.2. If Lach je Lens terminates the rental prematurely for any of the aforementioned reasons or events, the renter must still pay the full invoiced amount, and Lach je Lens will not compensate for the remaining rental period. Please note: Lach je Lens will make every effort to resolve the incident together with the renter and/or location before proceeding with termination of the rental.
09 Liability
09.1. Our services are fragile. Care and caution are required. Our services are not intended for persons under the age of 10 without parental supervision.
10.2. Rented services must be supervised from the moment they are installed at the location. Responsibility for this supervision cannot be transferred, even if you arrange for someone else to provide supervision temporarily at your own risk.
10.3. Supervision means, but is not limited to, providing actual physical supervision, preventing damage, addressing and removing persons when necessary, preventing and eliminating other factors that may cause damage, and, if damage nevertheless occurs, minimizing such damage as much as possible and preventing further damage to the rented services and property and to the physical well-being of third parties.
10.4. The customer is liable for our services under the concluded agreement from the moment the customer has taken possession of the services until the moment we have taken them back into our possession. This liability applies to all damage, other than normal wear and tear, and/or losses incurred by the landlord as a result of actions by the customer and/or third parties who can reasonably be considered to be the customer’s responsibility.
10.5. The customer indemnifies the landlord against any claims by third parties.
10.6. If the customer demonstrates that they have suffered damage as a result of an error by the landlord that could have been avoided through due care, the landlord’s liability for such damage shall always be limited to the amount paid out in the relevant case under the landlord’s professional liability insurance, increased by the amount of the deductible that, under the terms and conditions of the policy, is not borne by the insurer(s).
10.7. If the landlord is held liable and, for whatever reason, no payment is made by the insurer(s), the landlord shall only be liable for direct damage actually incurred, paid, or suffered by the customer as a result of a demonstrable failure by the landlord in relation to the services. The liability referred to in this article is limited to a maximum of one times the invoice value of the services, or at least the portion of the services to which the liability relates, with an absolute maximum of €2,000 including VAT.
10.8. The landlord is not liable for any deficiencies or failures of third parties engaged by the landlord.
10 Technical Problems
10.1. If technical problems of any kind occur with the photobooth, the period during which the photobooth was out of service will be compensated proportionally based on the duration of the downtime and the invoice amount.
We do not guarantee continued operation of the services in the following situations. Consequently, malfunctions resulting from these situations cannot be attributed to the landlord:
– When someone removes a component of the photobooth, such as a flash or backdrop.
– When someone attempts to move, adjust, or open the equipment.
– When someone presses their finger or another part of their body against the equipment’s lens.
– When someone blocks the printer’s paper output with a finger, hand, or another part of their body.
10.2. If the photos are no longer printed due to a printer blockage, the landlord will print the remaining photos afterwards and send them to the customer free of charge.
10.4. If the problems or malfunction cannot be resolved by telephone, we will come to the location as soon as possible to resolve the issue. If a problem or malfunction results from one of the situations mentioned in Article 10.1, the following charges will apply:
11 Loss or Damage
11.1. From the moment the services are delivered to the location, the customer is fully responsible and liable for any loss of or damage to the landlord’s services caused by misuse of the equipment by the customer, their employees, or their guests, other than normal wear and tear. Any resulting depreciation or damage to the installation shall be borne by the customer and/or their insurance.
11.2. The customer is responsible and fully liable for any loss of or damage to the services caused by theft, misappropriation, fire, accidents, force majeure, or other circumstances during the period in which the equipment is installed at the location. Any resulting depreciation or damage to the installation shall be borne by the customer and/or their insurance.
11.3. The customer is required to compensate the relevant damage based on the replacement value of these goods.
11.4. Once the damage has been assessed and the customer has been informed of the costs incurred, the customer must pay compensation for the damage within 30 days after the agreed date.
